A Bismarck man has been charged with felony child neglect after a toddler in his care had to be rescued from an apartment complex swimming pool.

Police allege 40-year-old Rolland Noheart didn't immediately come to the 18-month-old boy's rescue Tuesday night. Authorities also say that when Noheart finally pulled the boy from the water, he let the limp child fall over and strike his head on concrete.

The boy was hospitalized in intensive care. His condition wasn't released.

Noheart could face up to five years in prison if convicted. Court documents don't list an attorney for him, and a home telephone listing couldn't be found.

Court documents show Noheart pleaded guilty to a child neglect or abuse charge in 2005 and was sentenced to serve a year in prison.
