BISMARCK, N.D. (AP) — The trial for a South Dakota man accused of punching another man to death in North Dakota might be moved from McIntosh County.
KXMB says the attorney for Nicholas Caspers has asked Judge Bruce Haskell for a change of venue because of the county’s small population and the notoriety of the case.
Prosecutor Terry Elhard says based on a juror survey he would agree to moving the trial.
Caspers has pleaded not guilty to murder in the Feb. 28 death of Paul Varner and is scheduled for trial beginning Nov. 30.
Authorities allege that Caspers went to Varner’s home in Wishek and punched him, and that broken bones in Varner’s face caused him to suffocate. Caspers, an auctioneer with South Dakota-based Mobridge Livestock Market, claims self-defense.
