Thomas Kleinwachter was sentenced to 12 months in jail, with no credit for time served, and 25 years of probation last week in Polk County District Court for second degree criminal sexual conduct charges involving a victim under 16 years of age.
According to the complaint, Kleinwachter's juvenile female relative was staying at his house in Mentor for a few days during the 2011 Christmas holiday when she awoke to Kleinwachter groping her. He stopped the touching, asked her to go upstairs and she declined. According to the complaint, Kleinwachter returned and started to grope her again, getting more serious. The juvenile relative said he penetrated her and then went upstairs again. He apologized to her later and told his sister that, "it was in God's hands and he is sorry." Kleinwachter, according to the complaint, told authorities that his juvenile female relative was falling out of her shirt when he tried to adjust it and she awoke.
His sentence also included attending a sex offender program, registering as a predatory offender until 10 years after probation ends, a $1,000 fine, supplying a DNA sample, possessing no sexually explicit material, not accessing the Internet or 900 numbers unless authorized by probation, no alcohol, no drugs, no firearms, cannot vote, subject to random testing and searches, no contact with victim, no unsupervised contact with children, submit to polygraph examinations, no unsupervised contact with minor females including grandchildren unless pre-approved by probation, and to obtain permission for any overnight stays.
