A prosecutor has dismissed a bigamy case against a man who allegedly married a South Dakota woman while still married to a North Dakota woman, saying the case isn't worth the time.
Spink County State's Attorney Vic Fischbach told the American News that there are several reasons for his decision, including his determination that Michael Clements, 40, of Ashley, N.D., did not intentionally violate South Dakota law.
Clements was living in Ashley when he was charged with bigamy for marrying a woman in Aberdeen, S.D., in June 2011 before his divorce in North Dakota was final.
"He thought after just signing some papers, he was divorced," Fischbach said.
A circuit judge dismissed the case but the South Dakota Supreme Court earlier this month overturned that decision, clearing the way for Clements to be prosecuted.
Fischbach said Clements has been through enough and there are better uses of the justice system's time.
